Service Agreement

Thank you for choosing Melange Salon + Spa (“Company”, “we”, “us”, or “our”) for your beauty and self-care needs. We offer a relaxed and personalized salon experience as well as pride ourselves on providing high levels of customer care. By signing below, you agree to the following terms and conditions set forth in this agreement (the “Agreement”):

  1. Bookings. Your name, address, email, phone number, and at least one (1) emergency contact are required for all appointments.

  2. Services and Pricing. All services and prices may be subject to change without notice.

  3. Payment. For your convenience, we accept all major credit and debit cards, cash, GooglePay, ApplePay, E-transfer, PayPal and Sezzle. Payment is due upon completion of your service.

  4. Card Authorization. You authorize us to keep your signature and credit card information securely on file in our account. You also authorize us to charge your credit card for any outstanding balances when due.

  5. Punctuality. Please understand that appointment times are limited. If you are running more than fifteen (15) minutes late for your appointment, we may, at our discretion, still accommodate you in the remaining time frame or reschedule your service. For repeated tardiness, 50% of the service amount will be imposed as rescheduling charges. If we do not hear from you for twenty (20) or more minutes into your scheduled appointment time, it is considered a “No-Show,” and your card will be charged for 100% of the service scheduled. If a credit card is not on file, a negative balance will be added to your account for this amount.

  6. Cancellations At Melange, we take great pride in providing exceptional service and respecting the value of your time. As a small business, we require financial stability, and enforcing our cancellation policy is essential to maintaining that stability. To confirm your appointment, we require a credit card on file (securely encrypted) and/or a 50% non-refundable retainer fee which will be applied to your service. By booking an appointment with us, you agree to our cancellation policy as outlined below: Cancellation or Rescheduling: We understand that unforeseen circumstances may arise, and you may need to cancel or reschedule your appointment. If you need to do so, we kindly request that you provide us with at least 48 hours' notice. If you cancel or reschedule with less than 48 hours' notice, you will be responsible for 50% of the booked service, even if you reschedule to a later time. Illness: If you are feeling unwell, we kindly request that you reschedule your appointment for another time. Please do not come to the salon if you are symptomatic. Your health and the health of our team and other clients is of utmost importance to us. If you are unable to attend your appointment due to illness and you provide fewer than 48 hours' notice, you will be responsible for 50% of the booked service. Under 12 hours, 100%. Appointments left unconfirmed at 8 hours prior will be cancelled and charged 100%. Not showing up to your reservation is also a 100% charge. To ensure efficient scheduling and respectful treatment of our time, we kindly request that you refrain from changing your scheduled service within 48 hours of your appointment. In the event that you do need to make a change, please be aware that a fee equal to half of the full service will be charged. For example, if you have booked a full color but decide to switch to a haircut on the day of your appointment or within 48 hours of it, we will need to apply the half fee of the original custom color service. Thank you for your understanding and cooperation in this matter. In the rare instance that we need to reschedule your appointment, we assure you that any deposit made will be applied towards your next scheduled appointment. Our policies are in place to protect our business and to ensure that we provide our clients with the best possible service.​ It's important to note that getting hair services is a luxury, and we appreciate your understanding and cooperation in working with us to schedule appointments that are convenient for you. We strongly advise against taking time off work or other commitments to receive our services. If you choose to do so, it is at your sole discretion, and we are not liable for any inconvenience or loss of income that may result. Should you cancel more than three times with less than 48 hours from a scheduled appointment, a non-refundable 100%  deposit will be required for all future appointments scheduled.

  7. Adjustment Appointments. If you ever feel like you are not completely satisfied with our service, please let us know during your appointment or within SEVEN (7) DAYS after your service has been completed. If we’re notified of your wish for an adjustment, we will consider scheduling you for an adjustment. The price of this adjustment may vary depending on our interpretation of the specific circumstances and can range from no charge to cost of product only, to full price. Please note that this Agreement does not cover a change in the style or color from the initial request as that would be considered a whole new service in contrast to an adjustment.

  8. Refunds. Due to the fact that the time our team spends on your services can never be regained, we do not offer refunds on services.

  9. Right to Refuse Service. The safety of our staff and clients is paramount. As such, we reserve the right to refuse service to anyone we feel may pose a health or safety risk. This includes but is not limited to lice, skin infections, open wounds, contagious illness (continuous cough, displaying fever symptoms), or displays of any rude/obnoxious or otherwise inappropriate behavior. We will request that you leave our salon and you will be prohibited from returning.

  10. Product Returns. Product returns will only be accepted for unopened/unused or lightly used merchandise. You will receive a full credit towards your next appointment if you notify us of the return request within SEVEN (7) DAYS of your purchase.

  11. Guests, Minors, and Pets. Only those with appointments will have reserved spots to be seated. Our salon is not child or pet-proof. Hot styling tools, sharp scissors, chemicals, and a busy salon can become a safety hazard. We also ask that you refrain from bringing any pets other than service animals into the salon. Please advise us in advance if you will be accompanied by a service animal.

  12. Wheelchair Access. We have access for two (2) wheelchairs at a time in the salon. If you require any assistance, please advise us and we will do all we can to accommodate you.

  13. Smoking and Vaping. Please note that it is illegal to smoke or vape anywhere in our salon. 

  14. Personal Items. Please ensure you retrieve all your personal items before leaving our salon as we cannot be held responsible for lost items.

  15. Illness. If you are sick or are concerned you are sick, you must reschedule your appointment. The cancellation policy may apply.

  16. COVID-19 You agree to that and affirm that you as well as all cohort members, do not currently have, nor have experienced, COVID-19 symptoms, you have not traveled outside of the country, or to any city considered a 'hot spot' for COVID-19 infections within the past 14 days. If you have, you are fully vaccinated, or have received a negative test result. You have not knowingly been exposed to anyone diagnosed with COVID-19 within the past 14 days. ANY (ALL) STAFF at MELANGE SALON + SPA, and/or the business itself, cannot be held liable for any exposure to the virus that causes COVID-19 caused by misinformation or any false health history provided by each guest.

  17. Limitation of Liability. You shall not hold Melange Salon + Spa or our employees liable and agree to indemnify us for any harm, claim, loss, costs, damage, injury, or product reaction to any person or property arising, either directly or indirectly from our service, or any other reason whatsoever.

  18. Dispute Resolution. Any dispute arising from this Agreement must first attempt to be resolved by means of meaningful informal negotiations between Melange Salon + Spa and you. The period for informal negotiations shall be 90 days from receipt of the written notice of dispute unless such time is modified by written agreement between us. In the event that we cannot resolve a dispute through informal negotiations, we agree to submit the dispute to mediation. Within 14 days following the expiration of the time period for informal negotiations, either Party shall propose and agree upon a neutral and otherwise qualified mediator. In the event either of us fails to agree upon a mediator, either Party shall request mediation will be held in Edmonton, Alberta or another mutually agreed venue.

  19. Governing Law. This Agreement shall be governed by and shall be construed in accordance with the laws in the Province of Alberta.

  20. Entire Agreement. This Agreement represents all the terms and conditions agreed upon between us. No other understanding or representations, oral or otherwise regarding the Agreement shall bind any of us. This Agreement may not be amended, in writing, and signed by both of us. In any action or proceeding involving a dispute between Melange Salon + Spa and you arising out of this Agreement, the prevailing party will be entitled to receive from the losing party reasonable attorney’s fees.
